1. Agreement to Terms

Welcome to EverBright Solutions! By accessing or using our services, you agree to these Terms of Service. If you do not agree, please refrain from using our services.

2. Services Offered

EverBright Solutions provides landscaping and lawn care services. Detailed descriptions of services, packages, and schedules are available on our website or through direct consultation. All services are subject to availability and agreement to these terms.

 

3. Payment Policies

  • Billing & Late Fees: Payments are due on the agreed schedule. Overdue payments will incur a $25 late fee per 30-day cycle after 30 days of non-payment.

  • Non-Payment: Services will be paused after 30 days of non-payment and canceled after 60 days. Accounts in arrears will be sent to collections.

  • Refunds: Refunds or adjustments are provided only if payment has been collected and services were not rendered during the billing cycle.

 

4. Cancellation Terms

  • Mid-Contract Cancellations: Customers may cancel mid-contract. Services rendered will be charged on a pro-rated basis.

  • Annual Pre-Payments: Customers who pay annually will receive a pro-rated refund for unused services. Refunds will be processed within 30-60 days.

 

5. Property Access

  • Customer Responsibility: Customers must ensure property access on the scheduled service date. Options include leaving gates unlocked, providing access codes, or arranging a key drop.

  • Missed Access: If access is not provided, the service area will be skipped and addressed on the next visit at no additional cost. Repeated access issues (three or more within 12 months) may result in service cancellation.

 

6. Service Adjustments

  • Rescheduling: Customers may reschedule services without penalty with 48 hours' notice. Services will be rescheduled to the next available date before the following scheduled service.

  • Excessive Rescheduling: Services rescheduled more than three times within 12 months may result in cancellation.

  • Inclement Weather: Services delayed due to weather will resume promptly when conditions allow. Extended delays will result in a rescheduled service date with prior notification.

 

7. Liability & Insurance

  • Insurance Coverage: EverBright Solutions is fully insured to protect against damages and accidents.

  • Reporting Issues: Customers must report property damages or service issues within 72 hours of occurrence.

 

8. Customer Responsibilities

  • Property Preparation: Customers must ensure the property is free of toys, debris, outdoor furniture, or vehicles before service. Persistent issues may incur a $10 fee (waived for the first instance).

  • Mid-Year Adjustments: Prices remain locked for 12 months unless the property layout is altered, such as adding mowable areas or structures.

 

9. Dispute Resolution

  • Arbitration: Disputes will be resolved through binding arbitration. By using our services, you agree to forgo litigation except for matters permitted by law.

  • Customer Reviews: Customers have the right to share reviews unless defamatory, harassing, discriminatory, or otherwise unlawful.

 

10. Service Guarantee

  • Satisfaction Promise: Customers unsatisfied with services may clear their balance and terminate the agreement at any time.

11. Modification of Terms

EverBright Solutions reserves the right to modify these terms at any time. Updates will be posted on our website, and continued use of services constitutes acceptance of the revised terms.

 

12. Governing Law

These Terms of Service are governed by the laws of the State of Georgia. Any legal actions will be under the exclusive jurisdiction of Georgia courts.
